A building permit is required for any deck attached to your home, regardless of size. Detached decks over 10 sq m (108 sq ft) also need a permit. Before submitting, a Zoning Preliminary Review (ZPR) must be completed. The Town checks setbacks, lot coverage, and privacy screen height compliance under Zoning By-law 2010-40 first.
Properties in the Yonge Street and Davis Drive Urban Centres fall under Zoning By-law 2019-06. Properties near the Holland River or Fairy Lake may require LSRCA approval before the Town issues a permit. Spring and early summer are peak permit season in Newmarket. Start the process in fall or winter to avoid delays.
Newmarket has 47 designated heritage properties and 72 properties within the Heritage Conservation District on South Lower Main Street, protected under the Ontario Heritage Act. Decks on these properties require review by the Town’s Planning Department before a building permit is issued.
